Welcome to SmartieSitters. These Terms & Conditions (“Terms”) govern your use of the SmartieSitters website and services. By using our website, submitting a request, registering as a Smartie or Sitter, or connecting with another user, you agree to these Terms.

1. About SmartieSitters

SmartieSitters is a community-based platform that helps families connect with local high-school students (“Smarties” or “Sitters”) for peer tutoring, homework assistance, babysitting, and similar services.

SmartieSitters facilitates introductions and matching based on information such as subject, schedule, availability, and personality fit. SmartieSitters does not guarantee that every match will be suitable or available.

2. Eligibility

  • Parents/guardians must provide accurate information when requesting a service.
  • Students/Sitters must provide truthful and current information during registration.
  • Users must meet any applicable age requirements for the services they use.
  • Minors must have appropriate parental or guardian involvement where required by applicable law.
  • SmartieSitters may refuse, suspend, or terminate access where information is inaccurate or these Terms are violated.

3. User Responsibilities

You agree to:
  • Provide accurate and complete information.
  • Treat other users respectfully and professionally.
  • Use the platform only for lawful purposes.
  • Not provide false, misleading, or fraudulent information.
  • Not harass, threaten, discriminate against, or exploit another user.
  • Keep login and personal information secure.
  • Notify SmartieSitters of any safety concern, inappropriate behavior, or suspected misuse.

4. Tutoring Services

SmartieSitters may connect families with student tutors for academic assistance. Tutors provide peer-based educational support and are not professional teachers, licensed educators, or academic institutions unless specifically stated.

SmartieSitters does not guarantee:

  • A particular academic result or grade.
  • The accuracy of every tutoring interaction.
  • That a tutor will be available at a particular time.
  • That a particular tutor will meet every family's expectations.

5. Babysitting Services

Babysitting arrangements are made between the family and the selected sitter.

Parents/guardians are responsible for determining whether a sitter is appropriate for their child and for providing necessary instructions regarding the child's care, allergies, emergency contacts, routines, and other relevant information.

Sitters must follow reasonable instructions provided by the parent/guardian and must immediately communicate any emergency or safety concern.

SmartieSitters is a matching service and does not replace the responsibility of parents/guardians to make appropriate decisions regarding childcare.

6. Matching & Introductions

SmartieSitters may review submitted information and recommend a suitable Smartie or Sitter.

A match does not constitute a guarantee, endorsement, employment relationship, or certification.

Users are responsible for communicating with one another, confirming arrangements, and deciding whether to proceed with a service.

7. Safety

The safety of children, families, and student service providers is a priority. Users should:

  • Meet in appropriate and agreed locations.
  • Share emergency contact information when appropriate.
  • Avoid sharing unnecessary sensitive personal information.
  • Report suspicious, unsafe, or inappropriate behavior immediately.
  • Follow all applicable child-safety and safeguarding requirements.
  • SmartieSitters may take action, including removing a user from the platform, when safety concerns are reported or identified.

8. Payments & Fees

If SmartieSitters introduces paid services, any applicable service fees, tutoring rates, babysitting rates, cancellation fees, or payment terms will be communicated before the relevant service begins.

Unless specifically stated otherwise, SmartieSitters does not guarantee payment arrangements made directly between families and Smarties/Sitters.

9. Cancellations

Users should provide reasonable notice when cancelling or changing an agreed tutoring or babysitting session.

Any cancellation or refund policy applicable to a particular service will be communicated separately.

Repeated cancellations, no-shows, or misuse of the platform may result in suspension or termination.

10. Privacy

SmartieSitters may collect information necessary to operate the platform, process requests, make matches, communicate with users, and improve its services.

Users should review the SmartieSitters Privacy Policy for information about how personal information is collected, used, stored, and protected.

11. User Content

You may provide information, messages, reviews, feedback, photographs, or other content through SmartieSitters.

You represent that you have the right to provide such content and that it does not violate another person's rights or applicable law.

SmartieSitters may remove content that is unlawful, abusive, misleading, inappropriate, or inconsistent with these Terms.

12. Third-Party Relationships

SmartieSitters connects users but does not necessarily employ every Smartie or Sitter listed or introduced through the platform.

Any agreement between a family and a Smartie/Sitter is separate from SmartieSitters unless expressly stated otherwise.

Users should independently confirm schedules, rates, responsibilities, and other arrangements before beginning a service.

13. Disclaimer

SmartieSitters provides its services on an “as available” basis.

To the extent permitted by applicable law, SmartieSitters does not guarantee that:

  • The website will always be available or error-free.
  • Every match will be suitable.
  • A Smartie or Sitter will meet a user's expectations.
  • Tutoring will produce a particular academic outcome.
  • Babysitting services will be uninterrupted or available at all times.

14. Limitation of Liability

To the maximum extent permitted by applicable law, SmartieSitters and its owners, operators, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the website or services

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless SmartieSitters and its owners, operators, employees, and representatives from claims, losses, liabilities, damages, and expenses arising from: Your violation of these Terms. Your misuse of the website or services. Your interactions or arrangements with another user. Information or content you provide. Your violation of applicable law or another person's rights.

16. Suspension & Termination

SmartieSitters may suspend or terminate a user's access if the user:

  • Violates these Terms.
  • Provides false information.
  • Engages in unsafe or inappropriate behavior.
  • Misuses the platform.
  • Creates a risk to another user or the SmartieSitters community.

Users may stop using the service at any time.

17. Changes to These Terms

SmartieSitters may update these Terms from time to time. Updated Terms will be posted on the website with a revised “Last Updated” date. Continued use of SmartieSitters after changes are posted constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

18. Governing Law

These Terms shall be governed by the applicable laws of the jurisdiction in which SmartieSitters operates, without regard to conflict-of-law principles.

Any disputes will be handled in accordance with applicable law and the jurisdiction of the appropriate courts.
